This is the gap between having a consent system and having provable consent. GDPR Article 7(1) states it plainly: "Where processing is based on consent, the controller shall be able to demonstrate that the data subject has consented." The fourth question is: what were they shown? The record must include the version of the consent banner or privacy notice displayed at the time of consent. This is non-negotiable for any dispute about whether the user was properly informed. If your consent text or cookie categories changed after consent was given, the record must reflect which version was active when the user made their choice. Without version information, you cannot demonstrate that consent was informed — you can only show that someone clicked something at some point.
The fifth question is: how was consent obtained? The method of collection — whether through a consent banner button click, a preference center toggle, a granular category selection, or an automated signal such as Global Privacy Control — must be recorded. The mechanism matters because some methods (pre-ticked boxes, inactivity interpreted as consent) are explicitly invalid under GDPR, and regulators will examine the collection method to assess whether the affirmative action requirement was met.
The sixth question is: have they since changed their choice? The consent record is not a static snapshot. It is a log of the full consent lifecycle for each user. Initial consent, subsequent updates, and withdrawals must all be recorded, with the same granularity requirements applying to each event. When a user withdraws consent, that withdrawal event must be logged with a timestamp — not to satisfy a formality, but to demonstrate that processing based on that consent stopped when it should have.
Beyond the six mandatory elements, several additional metadata fields significantly strengthen the evidentiary weight of a consent record when it is produced in a regulatory context.
The URL or surface where consent was collected establishes where in the user journey the interaction occurred, which is relevant if there are questions about whether consent was obtained in the context of a specific service or for a specific purpose. The geolocation or jurisdiction context matters for multi-region operations where different consent standards apply — confirming that EU consent rules applied to an EEA visitor's interaction versus a non-EEA visitor who may have different applicable rights. The device and browser context (user agent string) corroborates that the interaction occurred through a real browser session rather than being generated artificially.
These fields do not replace the six mandatory elements — they support them. A record with all six mandatory elements and no additional metadata is legally sufficient. A record with extensive metadata but missing a timestamp or consent version is not.
Understanding what regulators request during audits — as opposed to what the GDPR text says — is where compliance teams gain practical clarity on what to build.
The primary request in most consent-related investigations is sample consent records for specific users or time periods. The regulator identifies a complainant, identifies a date range, and asks you to produce the complete consent history for that user or device identifier. Building the operational documentation and standard operating procedures that connect consent collection to actual processing enforcement — rather than maintaining them as parallel systems that may diverge — is the structural requirement that technical audits now test directly.
Automated log lifecycle management is increasingly necessary at scale. Manually managing the retention and deletion of individual consent records is operationally unsustainable for any organization processing EU data at meaningful volume. The CMP or consent management system should be configured with explicit retention periods tied to the underlying processing activity, with automated deletion workflows that execute deletion without manual intervention and produce deletion confirmation records. Critically, deletion of consent logs themselves must not occur prematurely — that is, while the processing they authorize is still active — as premature deletion eliminates your ability to demonstrate compliance for that processing period.
An audit-ready consent system is one where any member of your compliance team can retrieve a complete, structured consent history for any identified user within hours, export it in a regulatory-friendly format, and trace the full lifecycle from initial interaction through any subsequent changes or withdrawals.
The architecture for this starts with structured logging at the point of consent collection. Each consent event — including declines, which are as important as acceptances — must trigger the creation of a structured record containing all mandatory fields. Unstructured logging that captures raw session data and requires post-processing to extract consent information is not sufficient for rapid retrieval in an audit context.
Version control must be built into the consent infrastructure, not added retrospectively. Every change to your banner text, purpose descriptions, cookie categories, or policy documents should create a new version record with a timestamp. When initial consent is captured by a CMP, preference updates are stored in a CRM, email opt-outs are managed by an email platform, and mobile app consent is logged separately, no single system holds the complete consent history. A regulator who asks for the complete consent record for a specific user across all processing activities will not be satisfied by a response that requires aggregating data from four systems and reconciling conflicting records.
